SNOWBOARD LIMITED WARRANTY: SIMS Collective, Inc. (“SIMS”) guarantees the original retail purchaser that their new SIMS snowboard is free of defects in materials and/or workmanship for one (1) year from the original purchase date, or two (2) years from the market release date. If the SIMS snowboard is found to be defective, in the sole discretion of SIMS, SIMS responsibility shall be limited to either the repair or replacement of the defective product. In the event an exact replacement (model, size, and/or color) is no longer available, SIMS may replace the snowboard with one of comparable performance, size and value. Repaired or replaced SIMS snowboards are covered for the remainder of the original warranty period. This warranty applies only to new snowboards purchased from an Authorized SIMS Dealer and is non-transferable to subsequent owners.

All Warranty Claims must be accompanied by the original proof of purchase receipt which clearly identifies the Authorized SIMS Dealer, the SIMS product information and original date of purchase.

All Warranty Claims must be accompanied by the fully completed SIMS Snowboard Warranty Card which comes enclosed in the snowboard packaging. SIMS recommends completing your SIMS Snowboard Warranty Card within five (5) days from purchase and keeping it in a safe place. Carefully transcribe the SIMS snowboard serial number onto the Warranty Card. This can also help you in the case of loss or theft of your SIMS snowboard.

SIMS shall not be responsible for any costs, losses or damages incurring as a result of loss of use of your SIMS snowboard. All coverage under this warranty is void if any modification, change or alteration has been made to the snowboard after purchase. SIMS makes no other warranties, either express or implied. No Authorized SIMS Dealer may modify or revise the SIMS Limited Warranty terms and conditions.

EXCLUDED WARRANTY ISSUES - The following will not be considered warranty issues which include, but are not limited to:

(a) Damage caused by impact with rocks, stumps, logs, rails, concrete, metal, or any other non-snow objects.

(b) Damage caused by collision with, but not limited to, other riders/skiers, structures, lift towers, stationery and moving objects or vehicles.

(c) Damage caused by abrasion and inappropriate usage, including riding on non-snow surfaces.

(d) Damage caused by the use of solvents, adhesives or LOC-TITE.

(e) Damage from normal wear and tear.

(f) Damage caused by inadequate assembly, handling or strain, including transportation (Examples: damage from car racks, snowboard falling from car racks).

(g) Damage from personal and other property damages such as automobile accidents, fires, improper transportation or similar.

(h) Any intentional damage or unintentional damage caused by the rider’s carelessness, abuse, misuse, or neglect.

(i) Damage caused by, related to, or resulting from any modifications made to the snowboard after purchase (such as, but not limited to, cutting/modifying the tip or tail, using T-nuts).

(j) Damage incurred in shipping or from the air lines.

(k) Damage caused by improper mounting or adjustment of bindings, including, but not limited to, using improper length of binding mounting screws or incompatible binding hardware.

(l) Spinning or stripped inserts or damage to the insert or base due to improper hardware mounting is not a defect and is not repairable.

(m) Cosmetic stress cracks in lacquer and non-structural cracks due to normal usage.

(n) Any delamination to the top or bottom sheets as a result of impact.

(o) Scratches, chips, and/or indentations in the top sheet.

(p) Graphic fading, discoloration, or other aesthetic blemishes that do not impair performance of the board.

(q) Corroded edges and other issues arising from damp storage or lack of maintenance and care.

(r) Damage from improper rider/snowboard specifications (i.e. too much weight on too short of a board).

(s) Buyer’s remorse.

(t) Cracked edges - these are the result of normal wear and tear or impact.

(u) Minor base irregularities, including base dimples in binding insert area.

SIMS makes no express warranty or condition whether written or oral and SIMS expressly disclaims all warranties and conditions not stated in this limited warranty. To the extent allowed by the local law of jurisdictions outside the United States, SIMS disclaims all implied warranties or conditions, including any implied warranties of merchantability and fitness for a particular purpose. For all transactions occurring in the United States, any implied warranty of condition of merchantability, satisfactory quality or fitness for a particular purpose is limited to the duration of the express warranty set forth above. Some states or countries do not allow a limitation on how long an implied warranty lasts or the exclusion of limitation of incidental or consequential damages for consumer products. In such states or countries, some exclusions or limitations of this limited warranty may not apply to the purchaser.

HOW TO INITIATE A WARRANTY CLAIM - If you feel you have a potential warranty claim, email us at INFO@SIMSNOW.COM with the following information and attachments:

1. Your name and full description of the claim;

2. Close up photos of the issue from angles that will help us to analyze your claim;

3. Scanned copy or photo of the fully completed SIMS Snowboard Warranty Card;

4. Scanned copy or photo of the original proof of purchase receipt which clearly identifies the Authorized SIMS Dealer, SIMS product and purchase date.

All snowboards to be returned to SIMS for warranty inspection and coverage must first receive a written Return Merchant Authorization (RMA) email from SIMS. All snowboards must be shipped properly packaged, pre-paid and insured by the sender against risk of loss or damage together with a copy of the RMA. SIMS assumes no responsibility or liability for damages to the snowboard incurred during shipment. Shipping charges are non-refundable. SIMS will pay to return your repaired or replaced snowboard.

SAFETY GUIDELINES - NEITHER THE SIMS AUTHORIZED DEALER OR MANUFACTURER SHALL BE LIABLE FOR ANY INJURY, LOSS, DAMAGES, DIRECT OR CONSEQUENTIAL, ARISING OUT OF THE USE OR INABILITY TO USE THIS SNOWBOARD.PLEASE BE AWARE THAT AS WITH MANY OUTDOOR SPORTS AND ACTIVITIES, SNOWBOARDING PRESENTS CERTAIN RISKS, DANGERS AND HAZARDS WHICH CAN RESULT IN SERIOUS PERSONAL INJURIES OR DEATH TO YOU OR ANOTHER. PLEASE RIDE RESPONSIBLY AND WITHIN YOUR ABILITY. IF YOU ARE UNFAMILIAR WITH THE SAFE OPERATION OF THIS SNOWBOARD OR THE NECESSARY EQUIPMENT THAT IS USED WITH A SNOWBOARD (HELMETS, BINDINGS AND RELATED HARDWARE), SIMS ENCOURAGES YOU TO FIRST RECEIVE INSTRUCTION FROM A QUALIFIED AND CERTIFIED SNOWBOARDING INSTRUCTOR BEFORE USING THIS EQUIPMENT. THIS WILL ENHANCE YOUR ENJOYMENT OF THE SPORT AND PROVIDE YOU WITH VALUABLE SAFETY POINTS AND KNOWLEDGE WHICH CAN LESSEN THE INHERENT RISKS, DANGERS AND HAZARDS IN SNOWBOARDING. THIS SNOWBOARD SHOULD BE USED BY MINORS ONLY WITH THE DIRECT SUPERVISION AND CONSENT OF PARENTS OR LEGAL GUARDIANS. SNOWBOARD BINDINGS, BY DESIGN, ARE NON-RELEASABLE. THEREFORE, THEY MAY REDUCE THE RISK OF SOME INJURIES COMMON TO OTHER SNOW SPORTS, BUT NOT ALL INJURIES. BECAUSE THE BINDINGS DO NOT RELEASE, YOU MAY BE UNABLE TO FREE YOURSELF IN CERTAIN SITUATIONS, SUCH AS DEEP POWDER, AFTER AN INJURY AND/OR FALLING HEAD FIRST INTO A TREE WELL OR CREVASSE. NEVER RIDE ALONE AND DO NOT RIDE IF IMPAIRED BY ALCOHOL OR DRUGS. ALWAYS WEAR SAFETY GEAR, INCLUDING A PROTECTIVE HELMET. CHECK YOUR BINDINGS REGULARLY AND FOLLOW THE BINDING MANUFACTURER’S INSTALLATION, MAINTENANCE AND REPLACEMENT GUIDELINES.
